Who is at fault in my minor fender bender?
When changing lanes, if a car hits you near your back wheel. Whos fault is it?
I'm not giving a lot of detail because I don't think it's a good idea. Can you also tell me what kind of guidelines people would use to determine fault in this case?
If you got hit while changing lanes, it's your fault. As far as guidelines, insurance looks at who has the right of way and who could have prevented the collision. In your case, you didn't have the right of way when another car was present in the other lane and if you didn't change lanes, the accident wouldn't have happen. Insurance would also consider if the other driver could have avoided the accident. If the other driver knew you wanted to change lanes (such as if you had your blinker on) and attempted to not let you in, they could have some liability also. In most states, accidents are not 100% fault to one driver unless it's a rear end collision at a red light. I'm guessing in your case, it can go anywhere from 70/30 to 90/10 with the higher percentage of fault on the driver who changed lanes.
